1.1 The Regulations define the general terms and conditions for the User's use of the CoolCity View online service, which is operated by MGGP Aero Spółka z ograniczoną odpowiedzialnością with its registered office in Tarnów (address: ul. Karola Kaczkowskiego 6, 33-100 Tarnów), registered in the Register of Entrepreneurs of the National Court Register, with registration files kept by the District Court for Kraków-Śródmieście in Kraków, XII Commercial Division of the National Court Register, under KRS number: 0000026913, NIP: 8731256310, REGON: 850414002, BDO: 000081836, hereinafter referred to as MGGP Aero.

1.2 The Regulations are the regulations for the provision of services by electronic means within the meaning of Article 8 of the Act of 18 July 2002 on the provision of services by electronic means.

1.3 These Regulations are available free of charge on the website www.mapadrzew.com in a way that allows the User to obtain, reproduce and store the content of the regulations using the IT system used by the User.

1.4 The information and data presented in the CoolCity Service are for informational purposes only and cannot be treated as an official document or the basis for any administrative or official actions.

The terms used in the Regulations mean:

2.1 Third Party Data – data and databases originating from third parties, used in the Service. Third Party Data includes:

Orthophoto map – from the open GUGIK resource,
Administrative Boundaries PRG – from the open GUGIK resource,
Map – from the open OpenStreetMap resource.

2.2 Business Days – days from Monday to Friday excluding public holidays within the meaning of applicable Polish law.

2.3 Password – a set of alphanumeric characters and special characters necessary for the User's authorization when logging into the Account.

2.4 Civil Code – Act of April 23, 1964 – Civil Code.

2.5 Privacy Policy – a document detailing the principles of personal data processing and security specified in the Regulations, as well as defining the scope and manner of collecting and using information collected by MGGP Aero through the use of cookies, available at Cookie Policy.

2.6 Regulations – this document, regulating the provision of services by electronic means.

2.7 Complaint – the User's statement of knowledge, containing reservations regarding the services provided by electronic means;

2.8 Service – the CoolCity website, available at www.coolcity.eu.

2.9 Website Services – services provided by MGGP Aero to the User by electronic means within the meaning of the provisions of the Act of 18 July 2002 on the provision of services by electronic means, specified in the Regulations, consisting in using the CoolCity Service.

2.10 Act on the provision of services by electronic means – the Act of July 18, 2002 on the provision of services by electronic means.

2.11 User – a natural person, legal person or organizational unit without legal personality, to which a separate act grants legal capacity – conducting business activity on its own behalf, as well as a natural person not conducting business activity, using the CoolCity Service.

3.1 MGGP Aero informs that using the Service may be associated with a risk for each Internet user, consisting of the possibility of introducing harmful software into the User's IT system and obtaining and modifying their data by unauthorized persons. To avoid the risk of the above-mentioned threats, the User should use appropriate technical measures to minimize their occurrence, and in particular antivirus programs and a firewall.

3.2 The language used in the Service, including the language of the Agreement for the provision of CoolCity Services and Paid Services, as well as the language used in the communication between the Parties, is Polish.

3.3 To use the CoolCity Service, it is required to have an end device with access to the Internet, a web browser that supports cookies: e.g. Google Chrome (version 138.0.7204.169 or newer), Mozilla Firefox (version 142.0.1 or newer), Microsoft Edge (version 140.0.3485.54 or newer). The web browser must have JavaScript enabled in order to create an Account and place Orders, and also have an active email account.

3.4 Using the Service means any action by the User that leads to their familiarization with the content contained in the Service.

3.5 It is prohibited to use the Service in a manner inconsistent with generally applicable law and good customs, as well as in a manner inconsistent with the Regulations. It is prohibited for the User to provide unlawful content.

4.1 MGGP Aero enables the use of the following publicly available, free Website Services related to the Cool City View product through the CoolCity Service:

browsing content posted on the CoolCity Service,
uploading layers via WMS, WMTS, WFS,
displaying statistics of the parameters of the marked spatial units,
downloading JPG, PNG, PDF files or the entire QGIS project with data.

4.2 Using the CoolCity Service is possible 7 days a week, 24 hours a day, subject to prohibitions or restrictions arising from generally applicable law and any failures of the CoolCity Service or maintenance work on the CoolCity Service.

5.1 To the extent permitted by mandatory provisions of law, MGGP Aero's liability for non-performance or improper performance of obligations arising from the agreement for the provision of Website Services, as well as other obligations arising from the Regulations - MGGP Aero's liability is excluded.

6.1 The CoolCity Service and its individual components are protected by copyright law. All rights to use the CoolCity Service that have not been expressly granted to the User under these Terms or applicable law (including the provisions of the Act of February 4, 1994 - on copyright and related rights and the Act of January 27, 2001 - on database) remain reserved for MGGP Aero or entities granting MGGP Aero licenses to use individual works and other exclusive rights included in the CoolCity Service.

6.2 The User may use the CoolCity Service by displaying it, using the available functionalities, and downloading data made available for download in the CoolCity Service.

6.3 The User may use the data and databases placed in the CoolCity Service that are Third Party Data to the extent permitted by the rules for sharing Third Party Data:

6.4 The User undertakes that without the prior consent of MGGP Aero, they will not use trademarks, trade names, or symbols used on the website coolcity.eu.

6.5 All drawings, specifications, data sheets, advertising materials, or other materials provided by MGGP Aero to the User are the exclusive property of MGGP Aero. The User will not make any changes to these materials without the prior consent of MGGP Aero.

7.1 The principles of processing the User's personal data in connection with the provision of Website Services by MGGP Aero are specified in the document "Privacy Policy".

8.1 The current Regulations are available on the Website at all times.

8.2 MGGP Aero reserves the right to make changes to the Regulations for important reasons, in accordance with the procedure specified in this and the following points. An important reason is understood in particular as: changes in the scope of the Services provided, changes in the activities carried out by MGGP Aero, changes in generally applicable legal regulations. The amended Regulations will be made available in the Service.

8.3 MGGP Aero will inform about the change of the Regulations by means of a message visible in the Service.

8.4 The date of entry into force of the amended Regulations will be at least 14 days from the date of notification of Users about the change of the Regulations made in accordance with point 16.3.

8.5 The Service uses information stored by the server on the User's end device, which is then read each time the web browser connects (so-called cookies). The rules for using cookies are specified in the document "Cookie Policy" which is part of the Privacy Policy.

8.6 The law applicable to the Regulations is Polish law.

8.7 Disputes arising between MGGP Aero and a User other than a non-professional User will be settled by the court competent for the seat of MGGP Aero.
